Joseph Irungu alais Jowie has filed a notice of appeal against the death sentence issued to him by the High Court for the 2018 murder of businesswoman Monica Kimani.

Jowie, in the notice issued through his new lawyer Andrew Muge on Friday, March 15, intends to challenge his conviction for the murder and sentencing by Lady Justice Grace Nzioka.

“Take notice that Joseph Kuria Irungu alias Jowie appeals to the Court of Appeal against the decisions of the Honourable Lady Justice Grace Nzioka delivered in open court at Milimani, Nairobi on the 9th day February 2024 and in her written judgment dated 9th February 2024 whereby the Appellant was convicted of Murder and sentenced to death on 13th March 2024,” reads the notice.

Jowie, who had previously hired Hassan Nandwa to defend his case, says he intends to be present for the appeal hearing.

“The appeal is against the conviction and sentence,” reads the court document filed through his advocate Andrew Muge.

Jowie, was convicted of murder and sentenced to death after he was found guilty of the brutal murder of Monica at her Lamuria Gardens apartment.

The sentence, according to Justice Nzioka was based on the severity of the act emphasizing on the manner in which the deceased’s life was taken.; She said that she considered how the offence was committed, consequence of the offence and the personality of the accused person.

Justice Nzioka during the sentence hearing also considered Jowie’s character saying punishment fits the heinous crime that cost 29-year old Monica her life.

Maxwell Otieno, the Investigating Officer in case, described Jowie as violent and dangerous.

” He is an extremely dangerous person, violent in nature, he was involved in an assault case with one Rodgers at club 1824 when he was out on bond in this matter,” read Otieno’s report during the sentencing at Milimani court.

However his Family disputed Otieno’s claims describing him as a social, overly generous, respectful to authority and committed Christian.
