A Kenyan man has moved to the Judicial Service Commission seeking to ouster Chief Justice Martha Koome from office.
Michael Otieno Kojo, filed a petition at JSC, saying that Koome is unfit to hold office for allegedly failing to observing the law in appointing members of the tax appeal tribunal.
“it should always be remembered that each judicial officer occupies a special and revered position which must be protected both in public and private life,so as not to bring the judicial service generally into disrepute,” the petitioner stated.
“It is imperative therefore,that every judicial officer should adhere to this code with scrupulous car.”
Kojo argued that the Koome was not transparent, diligent and discriminated against those who applied to be members of the board.
He maintained that Koome was not honest in executing her powers as provided by the tax appeal tribunal act. The activist observed that the chief justice’s actions were illegal,rendering her unfit to continue holding the office.
“The actions of the chief justice in appointing members more than the stipulated requirement violated section 4b of the Tax Appeal Tribunal Act. The actions of the chief justice in the appointment of the tax appeal tribunal are indeed illegal, null and void and hence unfit to hold public office,” he said
