The Environment and Lands court in Nyamira has summoned Kisii Governor Simba Arati to appear in person on Tuesday , March 12 2024 at 10:30 am.
Acting County Secretary Robert Ombasa is to appear along with Simba Arati for the hearing of an application of alleged contempt of court filed by Rigoma Ward MCA Nyambega Gisesa.
Nyambega accused the Kisii County boss of failing to abide by a judgement of the Court over the Keroka Town Boundary that had been determined to have with a bigger share belonged to Nyamira County.
“The duo is to appear before Justice Mugo Kamau on Tuesday, March 12, 2024, at 10.30 am for the hearing of an application of alleged contempt of court filed by Rigoma Ward MCA Nyambega Gisesa.
Gisesa told the court that the governor allegedly failed to abide by a Court judgment over Keroka Town boundary dispute.
“Due to the urgency and sovereignty of the issue mentioned in the application and the gravity of the matter , the same will be mentioned in open court on 12/03/2024 at 10.30 am, ” the Court order reads.
The Kisii Court Government has already appealed the judgement by Justice Mugo Kamau which allocated the larger share of Keroka town to Nyamira.
In the ruling Justice Mugo set aside an agreement met by former governors James Ongwae and late Nyagarama that the borderline that runs through the main tarmac cutting across the two counties by half be used as a beacon.
This comes after allegations of armed police reportedly stormed the market area and demolished stalls and structures put up by traders.
Police lobbed tear gas canisters to disperse groups attacking each other over the boundary dispute that sprung up at the onset of devolution.
Traders saddened by the ongoing land row accuse the leaders from both counties of turning a blind eye to the escalating problem.
