Kenyan veteran artist, Hubert Nakitare, famously known as Nonini won an award of ksh 1 million by a court in Nairobi after his hit song ‘We Kamu’ was used without his consent has been suspended.
Online influencer Brian Mutinda borrowed Nonini’s iconic song “Wee Kamu” in an advertisement for TV manufacturing company Synix last year without permission.
The lawsuit named Brian Mutinda as the first respondent and Synix Electronics as the second respondent.
Nonini reacted to the ad with a tweet, saying, “Syinix Electronics decided to do a brilliant advert using my song We Kamu. The only problem is they didn’t ask for permission.”
The court ordered Brian to pay Nonini ksh 1 million as compensation for copyright infringement and pull the video down from all his social media platforms.
During his appeal, the content creator informed the court that his side of the story was not given sufficient consideration.
He clarified that it was his lawyer’s fault, not his own because he had chosen not to provide a defense before the verdict was rendered.
Brian has stated in court that he only found out about the ruling via news sources and tabloids on social media.
He disclosed that the rapper proceeded to harass him and insisted on receiving the money in a matter of hours.
Furthermore, according to the content creator’s new legal team, Syinix Electronics Limited, the company he worked for, made the error of using Nonini’s music instead of his.
” Syinix Electronics stood to benefit from the content, therefore, liability cannot be apportioned to me,” Brian said via papers filed in court.
Due to this development in the case, both parties have been ordered to appear in court on 11th June 2024, for submissions and setting of a new judgment date.
