The Court is expected to issue a direction tomorrow on whether the 7.5 Billion graft case facing Deputy President Rigathi Gachagua and others will be lifted or not.

This comes after an application by the prosecution seeking to have the case withdrawn on basis that investigations into the case are not complete and it will be prejudicial for the case to go on as it is.

Investigator Obadia Kuria, from the Director of Public Prosecutions (DPP) while serving the application on an affidavit told the trial magistrate that the evidence does not meet the threshold required to amount to a successful prosecution of the case and therefore, wants the case withdrawn under section 87 A of the criminal procedure code.

Section 87 A of the criminal procedure code empowers the DPP to arrest and charge the suspects over the same offense once they find new evidence.
