The Director of Public Prosecutions (DPP) has filed an appeal challenging the recent court decision that acquitted Embakasi East Member of Parliament, Babu Owino, in a case where he was charged with the misuse of a firearm in the shooting of Felix Orinda, popularly known as DJ Evolve.

The DPP contends that crucial evidence was not duly considered in the acquittal.

In his appeal, the DPP argues that the court did not adequately consider certain key aspects of the case, including the forensic evidence and eyewitness testimonies. The DPP maintains that these elements are essential in determining the culpability of the accused and ensuring justice is served.

“Although we respect the independence of the judiciary, we believe that crucial pieces of evidence were not given due weight in the recent court decision,” said the DPP in a statement. “Our primary goal is to ensure that justice is served, and this appeal is a step towards achieving that objective.”

The case, which has garnered significant public attention, dates back to January 2020 when the shooting incident occurred at a Nairobi nightclub. DJ Evolve sustained serious injuries, leading to a prolonged legal battle.

Babu Owino, who was re-elected as the Member of Parliament for Embakasi East, has maintained his innocence throughout the legal proceedings. His legal team is expected to vigorously defend the acquittal in response to the DPP’s appeal.
